KanoCollectibles is a retailer specializing in collectible cards, with a particular focus on the Pokémon Trading Card Game (Pokémon TCG). The products sold are original and purchased through official channels or authorized distributors, unless otherwise specified in the individual product description.

2. Acceptance of Terms

Access to the Website and the purchase of products imply the Client's full acceptance of these General Terms and Conditions of Sale (hereinafter "GTC"). The GTC in force at the time of the order apply to every transaction concluded on the Website.

KanoCollectibles reserves the right to update the GTC at any time. Changes will only apply to orders placed after their publication on the Website.

3. Products and Descriptions

3.1 Product Types

KanoCollectibles mainly sells:

Single cards from the Pokémon Trading Card Game (TCG)
Booster packs, displays, tins, collection boxes, and other sealed Pokémon products
Collectible accessories (sleeves, binders, deck boxes, etc.)
Vintage and out-of-production products

3.2 Condition of Single Cards

Single cards are classified according to internationally recognized standards in the collecting sector:

Mint (M) / Gem Mint: perfect card, without visible defects
Near Mint (NM): card in excellent condition, with any minimal imperfections hardly visible to the naked eye
Excellent (EX): card in good condition, with slight signs of wear
Good (GD): card with visible signs of wear
Light Played (LP): card with moderate signs of play
Played (PL): card with obvious signs of play

The condition of each single card is clearly indicated in the relevant product sheet. The photographs shown are representative of the actual product. KanoCollectibles strives to ensure maximum accuracy in the description and evaluation of conditions.

3.3 Sealed Products

Sealed products (booster packs, displays, tins, etc.) are sold in their original intact packaging. Opening the package excludes the right of withdrawal pursuant to art. 59, letter c) of Legislative Decree 206/2005 (Consumer Code), as these products by their nature cannot be returned after opening.

3.4 Authenticity

All products sold by KanoCollectibles are guaranteed to be authentic. In case of reasonable doubt about the authenticity of a product received, the Customer is invited to promptly contact customer service at info@kanocollectibles.com before initiating any return procedure.

3.5 Value Variability

The Client acknowledges that the market value of collectible cards and Pokémon products is subject to variations over time, depending on market factors (editions, rarity, trends, tournaments, etc.) independent of KanoCollectibles' will. The selling prices reflect the market value at the time of the offer's publication and do not in any way constitute a guarantee of the product's future value.

4. Prices

All prices indicated on the Website are expressed in Euros (€) and are inclusive of VAT, unless otherwise specified. Shipping costs are not included in the product price and are calculated and shown to the Client before the order is concluded.

KanoCollectibles reserves the right to change prices at any time, it being understood that the Client will be charged the price indicated at the time of order confirmation.

5. Conclusion of the Contract

The sales contract between KanoCollectibles and the Client is concluded with the Client's submission of the order through the online purchase procedure, subject to subsequent confirmation by KanoCollectibles.

KanoCollectibles reserves the right to refuse or cancel an order in the following cases:

Product unavailable or out of stock
Incomplete, incorrect, or unverifiable Client data
Failure to pay within the terms
Suspicion of fraud or illicit activity

In case of order cancellation, the Client will be promptly informed via email and any sums already debited will be refunded within the technical timeframe provided by the payment method used.

6. Payment

KanoCollectibles accepts the following payment methods:

Credit card / debit card: major international circuits are accepted via a secure payment gateway with SSL protocol
PayPal: fast and secure payment via PayPal account or card via PayPal
Bank transfer: the order will be processed only after receipt of payment. Bank transfer details will be communicated via email at the time of order. It is recommended to indicate the order number in the bank transfer description

Payment must be made in full before the order is shipped. In the case of a bank transfer, the order will be held pending for a maximum of 5 working days; after this period without payment being received, the order will be automatically canceled and the products will become available for sale again.

7. Shipping and Delivery

7.1 Shipping Methods

Orders are shipped via tracked express courier. All products are carefully packaged to ensure their integrity during transport. Valuable single cards are protected with sleeves, top loaders, and additional rigid protection, to ensure that the product arrives in the declared condition.

7.2 Shipping Times

Order preparation and shipping times will be indicated in the dedicated section of the Website and in the order confirmation. In case of unforeseen delays, the Client will be promptly informed via email. KanoCollectibles is not responsible for delays attributable to the carrier or force majeure events.

7.3 Shipping Costs

Shipping costs vary based on the weight, volume of the order, and destination. The exact cost is calculated and shown to the Client during the checkout process before order confirmation.

7.4 Delivery Verification

Upon receipt of the package, the Client is required to check the integrity of the external packaging before signing for receipt. In case of visible damage to the packaging, the Client must sign with reservation and immediately report the anomaly to KanoCollectibles via email at info@kanocollectibles.com, accompanying the communication with photographs of the package and its contents.

8. Right of Withdrawal

8.1 Right of Withdrawal for Consumers

Pursuant to articles 52 et seq. of Legislative Decree 206/2005 (Consumer Code), the Client acting as a consumer (natural person acting for purposes unrelated to their commercial activity) has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the products, without having to provide any reason.

8.2 Conditions for Exercising Withdrawal

To validly exercise the right of withdrawal, the returned product must:

Be in the same condition as it was received, as documented and described in the product sheet
Be in its original packaging, intact and untampered with
Not have suffered damage, alterations or modifications compared to the state of delivery
For single cards: be protected in the same way as it was sent (sleeve, top loader, etc.)
For sealed products: the right of withdrawal is NOT applicable if the original packaging has been opened

8.3 Withdrawal Procedure

To exercise the right of withdrawal, the Client must send an explicit communication to info@kanocollectibles.com before the expiry of the 14-day period, indicating: first and last name, order number, product(s) for which withdrawal is exercised, reason (optional).

After confirmation by KanoCollectibles, the Client must ship the products within 14 days. Return shipping costs are borne by the Client, unless the withdrawal is due to an error by KanoCollectibles or a defect in the product.

8.4 Refund

KanoCollectibles will refund the price paid within 14 days of receiving the returned product and verifying its condition. The refund will be made using the same payment method used for the purchase, unless otherwise agreed. KanoCollectibles reserves the right to withhold the refund until the integrity of the received product has been verified.

8.5 Exclusions from the Right of Withdrawal

The right of withdrawal cannot be exercised for:

Sealed products (envelopes, displays, tins, gift sets, etc.) that have been opened after delivery
Customized or specially ordered products

9. Legal Guarantee

Pursuant to Legislative Decree 206/2005 and Legislative Decree 170/2021 (implementing EU Directive 2019/771), KanoCollectibles guarantees the products sold against conformity defects for a period of 2 (two) years from delivery.

For used or vintage products (where clearly indicated on the product page), the legal guarantee is reduced to 1 (one) year from delivery, in accordance with current legislation.

The warranty does not apply to damage resulting from improper use, negligence, normal wear and tear, or alterations made by the Customer.

10. Intellectual Property

All content on the Website (texts, images, graphics, logos) is the property of KanoCollectibles or used under license from their respective owners, and is protected by current intellectual property laws.

The name, trademarks, and logos "Pokémon", "Nintendo", "Game Freak", "The Pokémon Company" and related products are registered trademarks of their respective owners. KanoCollectibles is not affiliated with, sponsored by, or endorsed by The Pokémon Company, Nintendo, or Game Freak. KanoCollectibles resells original official products without any modifications.

11. Limitation of Liability

KanoCollectibles is not responsible for:

Delivery delays attributable to the courier or to force majeure (strikes, weather events, etc.)
Indirect damages, loss of profit, or depreciation of the market value of purchased products
Website malfunctions due to external technical causes
Improper use of products by the Customer

12. Dispute Resolution – ODR

In case of disputes, the Customer may initially contact KanoCollectibles' customer service at info@kanocollectibles.com for an amicable resolution.

Alternatively, pursuant to EU Regulation 524/2013, consumers residing in the European Union have the possibility to use the ODR (Online Dispute Resolution) platform of the European Commission, accessible at the following address: https://ec.europa.eu/consumers/odr

For any dispute, the court of the consumer's place of residence or domicile shall have jurisdiction, in accordance with Article 66-bis of the Consumer Code.

13. Applicable Law

These General Terms and Conditions of Sale are governed by Italian law. For anything not expressly provided for, the provisions of the Consumer Code (Legislative Decree 206/2005), the Italian Civil Code, and relevant European directives apply.
